Terms of Service

These Terms of Service ("Terms") govern your use of the AdTrackHQ platform operated by AdTrackHQ ("we", "us", or "our"). By creating an account or using AdTrackHQ, you agree to these Terms.

1. Description of Service

AdTrackHQ is an affiliate marketing analytics and automation platform that connects to Meta (Facebook) advertising accounts and ClickBank affiliate networks to provide tracking, reporting, and campaign optimization services.

2. Account Registration

To use AdTrackHQ you must:

• Create an account using a valid Google account
• Provide a valid payment method (credit or debit card)
• Be at least 18 years of age
• Have authority to connect the Meta and ClickBank accounts you link to AdTrackHQ

3. Fees and Billing

By adding a payment method to your account, you authorize AdTrackHQ to:

• Place an authorization hold on your payment method equal to 10% of each verified sale at the time the sale is reported
• Capture that hold within 7 days of the sale date
• Charge your payment method for any outstanding fees

4. No Refunds

All AdTrackHQ platform fees are non-refundable. Fees are calculated on verified sale events reported by your affiliate network at the time of the event. Subsequent refunds, chargebacks, or reversals by the end customer or vendor do not affect AdTrackHQ fees. AdTrackHQ's service — tracking, attribution, and automated campaign optimization — is delivered at the moment of sale.

5. Chargebacks

If you initiate a chargeback against AdTrackHQ with your card issuer, your account will be immediately suspended and you will be charged a $25 chargeback processing fee. Repeated chargebacks will result in permanent account termination.

6. Connected Accounts

You are responsible for ensuring you have the legal right to connect any Meta or ClickBank accounts to AdTrackHQ. By connecting an account you represent that:

• You own or have authorization to access the connected account
• Connecting the account does not violate any third-party terms of service
• You will maintain compliance with Meta's Platform Terms and ClickBank's terms

7. Prohibited Uses

You may not use AdTrackHQ to:

• Violate any applicable laws or regulations
• Violate Meta's Platform Terms or ClickBank's terms of service
• Engage in fraudulent advertising or affiliate fraud
• Attempt to reverse-engineer, copy, or replicate the AdTrackHQ platform
• Share your account credentials with unauthorized third parties

8. Termination

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Non-payment of platform fees
• Initiating chargebacks
• Engaging in prohibited uses
• At our sole discretion with 30 days notice for any other reason

9. Disclaimer of Warranties

AdTrackHQ is provided "as is" without warranties of any kind. We do not guarantee that the platform will be uninterrupted, error-free, or that campaign optimization will result in profitable outcomes. Affiliate marketing involves financial risk and past performance does not guarantee future results.

10. Limitation of Liability

To the maximum extent permitted by law, AdTrackHQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, arising from your use of the platform. Our total liability to you shall not exceed the fees you have paid to AdTrackHQ in the 90 days preceding the claim.

11. Indemnification

You agree to indemnify and hold AdTrackHQ harmless from any claims, damages, or expenses arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law

These Terms are governed by the laws of the State of Washington, United States. Any disputes shall be resolved in the courts of King County, Washington.

13. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email. Continued use of AdTrackHQ after changes constitutes acceptance of the updated Terms.
